SHAW DR is a national dispute resolution firm offering Mediation, Arbitration and Family Dispute Resolution services Australia-wide. We offer voluntary dispute resolution opportunities to everyone for all types of disputes anywhere, anytime for fixed scaled fees.

Our practitioners are nationally accredited and have a law background.  They are all legally qualified and are accredited mediators or arbitration experts in their jurisdiction.  All practitioners comply with ongoing professional development and are committed to the ethos and guidelines of the Dispute Resolution Standards of the Mediation Standards Board. All practitioners are accredited by a recognised Mediators Accreditation Body. This means that SHAW practitioners have the emotional intelligence, training and skills to facilitate productive dispute resolution sessions. Our practitioners are patient, kind and passionate about helping you to achieve your desired outcome. We take time to understand your concerns and can succinctly articulate and summarise your perspective and concerns. We remain independent throughout and do everything to make sure you feel safe and supported at all times.

At SHAW, our job as dispute resolution practitioners is:

  • to guide and facilitate the dispute resolution process;
  • to facilitate discussion, brainstorming of options and the thorough exploration of your concerns;
  • to level the playing field, remove any power imbalance and ensure respectful behaviour at all times by everyone;
  • to be future focused and non-judgemental;
  • to remain as an independent third-party;
  • to bring insight into the potential barriers to your settlement.

We are confident to ask the difficult questions and drill down into the real issues and reality test options with you. However, you are always in control.  You decide how you want your dispute resolution session to end. The outcomes are decided by you and can then be legally formalised by your lawyer so that they are enforceable.

We believe that alternative dispute resolution is a viable alternative to courts and lawyers, because it is cost-effective, quicker, private & convenient and offers the opportunity for you to decide on creative and lasting agreements.

Which form of alternative dispute resolution option is right for you?

Mediation – Mediation is a voluntary, alternative form of dispute resolution and facilitated discussion, where people in conflict come together in a safe and fair environment to try and settle disputes with the support of an independent third party – the mediator.  Mediation is appropriate for commercial, workplace, contracts, council, personal and domestic disputes whereby all the parties are willing to come to the mediation, in good faith and genuinely want to resolve the dispute.

FDR – FDR is just for parents about parenting the children and their support and well being. Married and de facto couples separating are obliged to try Family Dispute Resolution (FDR) after separation to resolve parenting concerns for their children before resorting to Court and litigation.  FDR is a process to help parents consider and agree on the future lives of their children and family and decide how the future will be for them all.

Arbitration – Arbitration is a dispute resolution process that is similar to a mini trial in Court, where people in conflict agree to refer the final decision to a mutually respected independent third party – the arbitrator.  Arbitration is commonly used if the lawyers are not recommending or supportive of mediation for whatever reason.  It is also the logical next step following a mediation where not all the issues were agreed upon.
